The out of the blue is in the position below i play 9 Nxe5 which is a mistake but its not at all obvious why. if you have the same position but both sides havent castled its an even position because the king can defend the d3 pawn easily.

The line from 9.Nxe5 which makes this a mistake goes 9...Bxe2 10 Nxc6 Bxd1 11 Nxd8 Bc2!! 12 Nxb7 Bxd3 and the Blacks light squared bishop picks up a whole load of centre pawns.

In what sense did you invent this line? The position up to and including 8.0-0 is known from a 1979 Polish game, Błażej Olchówka (1673) - Marcin Olesiak (1979). That continued 8...Nd7!? 9.h3 Bxf3 10.Bxf3 with what looks like a roughly even position (but 1-0, 38 moves).

I don't think it matters. Chessbase and similar have been around for over thirty years and megasized databases capturing all the recorded historic games almost as long. If claiming a novelty, it has to be something never previously played, not something never previously published in book or article form.

some odd things happened when i started playing this line back in 2010, namely everytime i looked for other games played in the line, more historic games in the line appeared, like someone was adding lines either made up or found from other databases.

i am claiming 9 Nxe5 as a novelty(which isnt in livebook) and i am claiming i was the first player to play the d3 kid as a regular system

i played a similar line for the first time in 2016( the Knight takes e5) thats when i invented it,

Not sure I really agree. If I play what I genuinely believe is a TN, and there is indeed no previous published record of that move having been played, I don't think that the subsequent revelation that it was played some years earlier by two 8-y-o's during school lunch break alters this.

Interestingly, I don't believe Magnus Carlsen played the English Opening until he saw me play it at Gausdal (and joined in the post mortem). It's probably just a coincidence, but I prefer to think otherwise.
