Question about K factor limitation in a month

Hi,
I was trying to calculate for my son what could his next FIDE grade be, but then I realised that:
I therefore assume that his 9 April games will be included in the above rule, and he will be considered to have played 19 or 23 games, meaning his K will be deflated to either 30(!!!) or 37? Wouldn't it be fairer and more logical to check which month the tournament relates to? He will be playing only 14 games this month, which is under the limit to trigger the clause, yet it looks like he will be punished for the organisers' delays! (he could lose up to 30 points if my understanding of the above is correct, ignoring his next 4 games' outcome)

- he has played 10 games in May to date
- he should play a further 4 games in May which may or may not be submitted in time for the next rating list
