I suppose they (not Agon but World Chess U.S. Inc and World Chess Events Ltd) are hoping for a clueless judge to give them what they ask for.
The potential audience is being counted in millions rather than hundreds of millions, but it's the existence of chess sites that has built the audience for online chess in the first place, so I don't think the following statement is justified.

Is a judge able to make a decision during an election? Who are the other 2 parties being sued.
Who can they sue if for example someone posted first move 1.d4 on this forum?

They (Agon/worldChess) are complete crooks - sadly after a few days they eventually spotted my links to the chess24 coverage on their facebook pages - but I would encourage everyone to avoid giving Agon their $15 - either give chess24 a one month subscription or donate to CSC during the Classic instead if you feel you should be paying for coverage

Interesting, the focus pre-match used to be on who might be the secret seconds for the players, and which openings they might play, and indeed who might win the match and what the score would be - Agon have certainly managed to change that
