It would appear that Hans Moke Niemann has had his case thrown out of court. Reasons are, perhaps, not entirely clear.

I cannot find mention of who is liable for costs in this '$100 million' lawsuit.
Both sides always pay their own costs in US lawsuits. Absent a successfully granted (rare) application for sanctions if the suit can be considered frivolous.

Still FIDE has to provide their judgement. They are between a rock and a hard place: either Niemann has cheated and should be disqualified, or Carlsen withdraw from a tournament making false accusations and should be sanctioned. Tertium non datur.

Yes, someone is in the wrong. I think they might just sweep it under the carpet though and consign it to the past.

FIDE could, I suppose, take a third option of saying "we have insufficient evidence to rule against either player", or something.

I agree. I think for the sake of peace and diplomacy, FIDE are more likely to take this option.
Is it possible we could have a thread merge on the English Championships 2023 in the Congress Diary Category?

Hans Niemann’s $100 million lawsuit against Chess.com, Magnus Carlsen, Hikaru Nakamura, the Play Magnus Group and Danny Rensch was dismissed by the U.S. District Court in the Eastern District of Missouri, but that doesn’t mean that Niemann’s legal options are finished. The Court dismissed the anti-trust components of the suit “with prejudice”, which means that Niemann can’t relitigate that part of his lawsuit. The remaining elements of the case, focusing on defamation claims, were dismissed on jurisdictional grounds and without prejudice, which leaves open the possibility of Niemann re-filing on those parts of the lawsuit elsewhere.

In fact, this is apparently what Niemann and his attorneys intend to do, so it’s (probably) not over yet

You're technically correct from the framework of the Solar System, but on a grander scale uncle Albert taught us that there are no fixed points in space which we can use as privileged reference points. No ether, no grid. Instead everything is relative to everything else.

The way you see the world depends on your point of view and context.

So, from our point of view the Sun rises in the East, from the point of view of the Solar System this is an illusion brought about by the position and relative motion of the Earth, but from the viewpoint of a distant star or Galaxy the Sun and Solar System and even our Galaxy may be moving in all sorts of ways which we are oblivious of.

Not good enough. Either there's enough evidence to prove Niemann cheated or there is not.
If such evidence does not exist, then Carlsen's behavior needs to be sanctioned.
Anti-cheating measure needs to protect players against cheaters, but also protect them against frivolous claims of cheating.

What more evidence would be required to sanction Carlsen? He disregarded due process by quitting the event and accusing Niemann of cheating. He could not provide any substance to his accusations. What more would be required?

I am probably a bit more sympathetic to Carlsen than Paolo. But seems very likely to me FIDE will impose some sanction on him. Even if you believe a FIDE inquiries more political than judicial, he has hardly endeared himself to them.

Warning as to future conduct and a suspended 3 month ban from FIDE events would seem reasonable to me.
