Category H ratings

The Help page on the Rating website states - "On 31st December 2022, any player still with an H rating will be converted to unrated ".

My club has a player who is still cat H in the January list, whose last game was in February 2020. It appears that the criterion for unrated players "no rated result in the previous 36 calendar months" has been applied here, regardless of the above stipulation for category H.

Can anyone explain?
